1. GENERAL TERMS AND CONDITIONS

1.1 General terms and conditions

These general terms and conditions of sale apply to all sales transactions concluded by Loisirs Loire Valley.

LOISIRS LOIRE VALLEY, a sole proprietorship by Patricia Allouin-Ratton, has been registered in the register of travel and holiday operators under the number IM04115003 attributed by ATOUT FRANCE, with financial guarantee by CIC OUEST and RC Pro MMA IARD insurance.

Depending on the type of product sold, special conditions apply.

Loisirs Loire Valley sells :

- Ticketing for access to the park

- Catering (drinks and sweets)

- The organisation and/or management of all or part of event-based services, such as seminars, team building, inaugurations, company anniversaries, incentives, garden parties, workshops, company parties, conferences, meetings, and all event-based and marketing communication operations.

The present general conditions and the special conditions applicable to the product sold are an integral part of the sales contract.

1.2 Capacity

Any customer of Loisirs Loire Valley acknowledges having the capacity to contract under the conditions described in the general terms and conditions of sale presented below, i.e. having reached the legal age of majority and not being under guardianship or curatorship.

Any customer of Loisirs Loire Valley acknowledges having read these terms and conditions of sale before placing an order.

All customers of Loisirs Loire Valley acknowledge that they have read the internal regulations and safety conditions of the park and its activities before entering the park.

Consequently, the placing of an order or the purchase of a ticket implies full acceptance of the general and special terms and conditions of sale of Loisirs Loire Valley and unreserved acceptance of all their provisions.

1.3 Price display

All prices are displayed in Euros. VAT is always included, excluding specific aerial work. Our individual prices are subject to slight modification during the season. The group and EC ticketing rates are firm and definitive.

1.4 Payment methods

Loisirs Loire Valley accepts Carte Bleue, Visa, Eurocard / Mastercard, bank or postal cheques, online payments via the Loisirs Loire Valley ticketing service, bank transfers or money orders. Cash is only accepted for payments made on site. Payments must be made in € (Euro) to Loisirs Loire Valley.

1.5 Force majeure

Force majeure is any event external to the parties which is both unforeseeable and insurmountable and which prevents either the client, the travellers, the agency or the service providers involved in the trip from carrying out all or part of the obligations provided for in the contract.

By express agreement, this will be the case in particular in the event of a strike of the means of transport, Loisirs Loire Valley staff, insurrection, riot and any prohibition whatsoever issued by the governmental or public authorities.

It is expressly agreed that force majeure suspends the performance of the parties' mutual obligations.

At the same time, each of the parties shall bear the cost of all expenses incurred as a result of force majeure: consequently, the travellers alone shall bear any additional costs that may be incurred to enable the journey to continue following the occurrence of a case of force majeure.

1.6 Liability of Loisirs Loire Valley

Loisirs Loire Valley is not liable for the loss, theft or damage of goods left in the premises made available to the customer. The customer undertakes to comply with the safety instructions given by the park staff or posted in the park.

Each visitor must comply with the instructions for Loisirs Loire Valley activities. All departures from the park may not be more than 5 minutes late - subject to availability - or to cancellation without refund.

Loisirs Loire Valley reserves the right to expel any offender who will not be entitled to a refund of their activity tickets.

Minors must be under the responsibility of an adult supervisor, even in the presence of a Loisirs Loire Valley instructor.

Civil liability of customers:

Each visitor is responsible for any damage, direct or indirect, that he/she may cause during his/her presence on the Loisirs Loire Valley leisure areas.

1.7 Internal regulations

Each visitor must comply with the internal regulations of the Loisirs Loire Valley park displayed at the entrance. Loisirs Loire Valley is entitled to expel any offender without recourse. Visitors who are expelled in this context may not be reimbursed for their entrance tickets.

1.8 Information technology and civil liberties

In application of the French Data Protection Act 78-17, customers are informed that their order is subject to computerised personal data processing. The right of access and rectification guaranteed by the law is exercised by Loisirs Loire Valley.

1.9 Complaints

Any complaint concerning the ticketing, the reservation, or the execution of the contract concluded with Loisirs Loire Valley must be addressed to Loisirs Loire Valley, Domaine de la Pépinière 41150 CHOUZY-SUR-CISSE.

In order to avoid any dispute, proof of visit (email messages, vouchers, invoice, etc.) including the number of participants must be attached to the complaint.

2. SPECIAL CONDITIONS APPLICABLE TO THE RESERVATION AND PURCHASE OF TICKETS

2.1 Advance offer

The prior offer referred to in the law of 13 July 1992 is made up of the information given in the commercial documentation, on the website www.loisirs-loirevalley.com, as well as by the present Conditions of Sale.

2.2 Booking conditions

2.2.1 In the case of undated individual ticket orders

Group ticket orders benefit from special rates that are only applicable to the category mentioned.

This type of rate applies to Works Councils or similar.

These rates are applicable to all orders of a minimum of 10 tickets (adults and children combined).

Individual tickets are valid for the opening period of the year of purchase.

Tickets will only be sent out on receipt of full payment for the order.

2.2.2 In the case of group services or dated tickets Groups at Loisirs Loire Valley

Group rates are only applicable to the categories listed.

This type of rate applies to: groups of 10 people or more, quad bikes of 5 people or more, schoolchildren, day-care centres and camps, specialised educational centres, booking on a fixed date and coming to Loisirs Loire Valley by the same means of transport (coach or minibus). Group rates are granted for the reservation and purchase by the same person of a collective entry ticket or a package, with a single payment for the group.

The contract is only definitively concluded after the return to Loisirs Loire Valley of a copy of the quotation or contract duly signed within 14 days of its receipt (or immediately, in the case of a reservation made less than 21 days before the date of the service) accompanied by payment of 30% of the amount of the services reserved.

In all cases, the deposit must be paid no later than 15 days before the date of the group's arrival.

The balance is payable at the end of the service.

In the case of a group of more than 100 people, the prepayment of the totality of the service must be made at least 7 days before the date of the group's arrival.

For advance payment of dated tickets, 100% of the reservation must be paid at least 15 days before the date of the visit. The tickets ordered are then sent by post with acknowledgement of receipt. Postage costs are payable by the Customer at the rate in force on the day of dispatch.

2.2.3 Specificity of schools, town halls, local or regional authorities

The contract is only definitively concluded after the return to Loisirs Loire Valley of an order form or an administrative form.

2.2.4 

As the customer is the sole judge of his or her ability to complete the obstacles, no reimbursement will be possible for a course started and then interrupted on his or her own initiative for any reason whatsoever.

3. SPECIAL CONDITIONS FOR THE ORGANISATION AND BOOKING OF EVENTS

3.1 Prior offer

The prior offer referred to in the law of 13 July 1992 is made up of the information given in the commercial documentation, on the website www.loisirs-loirevalley.com, as well as by these Terms and Conditions of Sale.

3.2 Booking conditions

The quotation, together with these general terms and conditions of sale, constitutes a proposed contract for which the Client, or any agent on his behalf, expressly declares that he has the power, authority and capacity to enter into the contract and to perform the obligations incumbent on him.

By express agreement between the Client and Loisirs Loire Valley, the act of sending the signed quotation or order form alone constitutes acceptance of the terms of the contract and in particular of these general terms of sale. For certain events, the agency may also impose the general conditions of its partners, which must also be applied. In this case, the agency will send the client details of these conditions in addition to the quote.

By express agreement between the Client and Loisirs Loire Valley, in the context of the organisation of an event, it is agreed that the Company will make firm reservations with its service provider(s) only after receipt and effective collection of the first or single deposit. In the event of the unavailability of the planned service provider(s) for the desired date following the period between the drawing up of the estimate and the receipt of the deposit, the agency will do its utmost to propose to the Client one or more equivalent or similar service providers for the contracted services. This new proposal from the agency is not binding on the Client who is free to accept it or not. If the Customer accepts the new proposal, the relationship between Loisirs Loire Valley and the Customer continues under the conditions stipulated herein and without modification of the initial contract. If the Customer refuses the new proposal, the deposit(s) will be reimbursed to the Customer within 30 days of receipt by the Company of the written refusal of the said proposal.

3.3 Client's obligations

The Client undertakes not to conceal from the Organiser or its partners any information relating to the event which could delay, hinder, interfere with or disrupt the project or its implementation. The Client shall facilitate access to any information required by the Organiser.

The Client undertakes to respect and comply with the special conditions of the selected participant(s) and in particular to pay any bond or guarantee that may be necessary before the full payment of all sums due.

The Client undertakes not to intervene directly, before, during or after the event, with the Organiser's suppliers, subcontractors, staff and employees.

If, after a possible termination of the contract, the Customer carries out or has carried out the event which was initially defined by Loisirs Loire Valley, a sum equal to 30% of all the estimated and plagiarised projects will be due to Loisirs Loire Valley.

3.4 Payment

The booking is only validated after receipt of a payment of 30% of the amount of the services booked.

In all cases the deposit must be paid at least 15 days before the date of the group's arrival.

The balance is payable at the end of the service.

In the case of a group of more than 100 people, the prepayment of the entire service must be made at least 7 days before the date of the group's arrival.

4. CONDITIONS OF MODIFICATION OR CANCELLATION

4.1 Modification of the contract or partial cancellation

Any modification of the contract must be requested in writing by the client. In the event of disagreement Loisirs Loire Valley reserves the right to cancel the contract and apply the penalties indicated in 4.3.

The customer must also inform Loisirs Loire Valley of any change in the number of participants at least 7 days before the date of the service.

Partial cancellations by the client are not subject to any penalty if they represent less than 10% of the amount of the booking and provided that Loisirs Loire Valley is notified by email contact@loisirs-loirevalley.com or loisirsloirevalley@gmail.com .

A reduction in the number of participants less than seven days before the date cannot be taken into account in the invoicing (except in the case of force majeure as described in article 1.5 of these conditions of sale).

4.2 Transfer of the contract

The customer may not assign the contract concluded with Loisirs Loire Valley.

4.3 Cancellation at the customer's request

Cancellation or modification of a booking by Loisirs Loire Valley, mainly due to bad weather conditions or unavailability of instructors, entitles the client to postpone the session to a later date or to a refund of the price.

4.5 Covid 2019 

If the Loire Valley Leisure Centre is forced to close by government order due to COVID-19 or other pandemic, or if you are unable to travel due to restrictions put in place by your Government or the French Government and you are unable to travel because of this, you are unable to attend your activities, by virtue of order No. 2020-315 of 25 March 2020, our agency is authorised to offer you, instead of the refund provided for in Article 211-14 of the French Tourism Code, a credit note corresponding to the totality of the payments made for the travel services booked.

This credit note is valid under the following conditions:

- This credit note is valid for a period of 18 months from the date of cancellation of your initial contract

- This credit will be accompanied by a proposal for a new booking at a later date.

If you have not used the credit by the end of the 18 months, it will be refunded in full.

This also applies to the extent that the Government imposes a quarantine once you arrive in France or in your country of residence.

However, if there are no travel restrictions in place and you decide not to travel because of COVID-19 or similar, our terms and conditions will apply. For example, if you take out COVID-19 and have to cancel your booking less than a month before the start date of the activity, Loisirs Loire Valley will consider this as a cancellation due to illness and therefore our terms and conditions will apply. We will be able to provide you with a document proving that you were unable to attend your activity so that you can make a claim on your insurance.

5. DISPUTES

Any claim relating to the booking/online ticket purchase/activity must be sent by email to contact@loisirs-loirevalley.com within fifteen (15) days of the booking/online ticket purchase/activity, together with supporting documentation to prove the claim, otherwise the claim will not be processed.

If no agreement is reached within sixty (60) days of the complaint, the customer may have recourse, free of charge, within a maximum period of one year after the complaint e-mail, to either

In the absence of an amicable settlement, disputes will be brought before the competent courts.

RÈGLEMENT INTERIEUR

I – HORAIRES D’OUVERTURE ET DE FERMETURE, DROIT D'ENTRÉE

La Base est ouverte de 10h à 18h ou de 10h à 19h selon la saison, son accès est soumis à l’achat d’un billet d’activité.

Un ensemble de jeux gratuits peuvent être en libre accès sur ces plages horaires. Les activités payantes sont soumises à un planning d’ouverture affiché sur le site, ainsi que leurs tarifs.

Cas de fermeture exceptionnelle de certaines activités : en raison de conditions météorologiques susceptibles de mettre en danger les utilisateurs ou le personnel (orage par exemple), certaines activités peuvent faire l’objet d’une fermeture exceptionnelle sans préavis. Aucun remboursement ne sera fait dans la mesure où la prestation aura été partiellement consommée.

II –ACCÈS DES VÉHICULES ET STATIONNEMENT

La circulation et le stationnement des vélos, chevaux, véhicules motorisés immatriculés ou non sont strictement interdits dans l’enceinte de la Base en dehors des parkings. Seuls les piétons et les véhicules d’intervention sont autorisés à entrer dans la Base Plein Air. En dehors des véhicules de secours, la vitesse autorisée pour tous les véhicules à moteur ne doit pas dépasser 10 km par heure.

Le stationnement des véhicules y compris les vélos se fait sur les parkings prévu à cet effet. Les véhicules en stationnement gênant et ceux entravant la progression des véhicules de secours et d’intervention urgents seront enlevés pour permettre en permanence une libre circulation.

Le camping – caravaning est strictement interdit dans l’enceinte et sur le parking de la Base.

III – PROTECTION CONTRE LES RISQUES D’INCENDIE ET UTILISATION DE BARBECUE

L’allumage de feux et l’utilisation de feux d’artifice ou objets similaires, fusées, feux de Bengale, pétards etc. sont interdits. Les barbecues sont interdits dans l’enceinte de la Base.

IV – UTILISATION DES ESPACES SPECIALEMENT AMENAGES

La Base Plein Air met à disposition des usagers des espaces de détente, de sport et de jeux sous le contrôle du personnel de la base. Certains espaces de jeux possèdent leur propre réglementation qui s’adjoint au présent règlement. Tout utilisateur de ces espaces est tenu de se conformer aux règlements, consignes et tranches d’âge prévues pour la pratique de ces activités.

Lorsque des conditions particulières (âge, taille,) sont exigées ou conseillées pour des raisons de sécurité évidentes, l’accès à certaines activités peut être refusé à toute personne ne remplissant pas ces conditions.

Les équipements doivent être utilisés selon la destination pour laquelle ils ont été conçus. Enfants et adultes doivent faire en sorte de ne pas dégrader les installations mises à leur disposition.

La responsabilité de Loisirs Loire Valley ne pourra être engagée dans l’hypothèse d’une mauvaise utilisation des équipements.

V – COMPORTEMENTS DES USAGERS

1 – Comportement de l'ensemble des usagers

Les enfants doivent être placés sous la responsabilité et la surveillance d’une personne majeure sur l’ensemble du site, des jeux et des locaux, même en présence d’un agent. Le public est tenu de se conformer aux recommandations du personnel et des textes réglementaires.

La pratique des activités de détente et de loisirs ne doit pas créer de nuisance ou de gêne aux autres utilisateurs.

Les comportements des usagers ne doivent pas choquer ou porter atteinte aux bonnes mœurs, à la quiétude, la sécurité et la tranquillité des autres usagers ainsi qu’à la salubrité des espaces qui restent destinés à des pratiques d’activités sportives, culturelles, de loisirs et de détente.

Pour le respect du site, de la salubrité et de la tranquillité de tous, les règles de comportement suivantes seront observées :

· ne pas déposer de sacs contenant des détritus de toute nature et collaborer aux dispositions relatives au tri sélectif concernant les déchets de produits achetés au snack/bar de la base. Les jets de débris, bouteilles, détritus et objets quelconques sur le site sont interdits.

· respecter les espaces et les équipements mis à disposition et notamment les installations sanitaires dont l’usage est obligatoire. Il est interdit de jeter quoi que ce soit dans les canalisations, les poubelles ne sont pas destinées aux détritus des pique-niques.

· ne pas jeter de projectile, utiliser d’armes ou engins utilisant des projectiles.

· éviter les consommations excessives de produits pouvant générer des troubles du comportement susceptibles d’engendrer des risques pour l’intégrité des personnes et des biens ainsi qu’à la sécurité des autres usagers.

· Les propriétaires d’appareils ou d’instruments sonores veilleront à ce que les bruits émis ne gênent pas les autres usagers.

2 - Règles applicables aux groupes

Un groupe, au sens du présent règlement, est une structure collective de droit public ou privé. Il possède une personnalité juridique ou morale.

Tout groupe doit avoir un responsable qui s’assurera du respect du règlement par les membres du groupe. Le responsable devra prendre les mesures propres à assurer la sécurité des participants et la tranquillité des autres usagers.

Le responsable du groupe devra se faire connaître dès son arrivée. Il indiquera les données nécessaires à l’identification du groupe, raison sociale – nombre de participants – nombre d’encadrants – signes d’identification des participants – durée approximative de la présence – activités projetées.

Durant leur présence sur la Base, les membres du groupe restent placés sous la responsabilité juridique des organisateurs et des encadrants.

VI –ANIMAUX

Les animaux sont interdits à l’intérieur de la Base.

Tout animal considéré en état de divagation pourra être capturé par les services spécialisés et remis pour hébergement aux services habilités par les autorités sanitaires départementales.

Il est également interdit de garder des animaux enfermés dans les véhicules.

VII- RESPONSABILITÉ - RÉCLAMATIONS

Loisirs Loire Valley décline toute responsabilité vis-à-vis des accidents dus au non-respect des consignes de sécurité, des vols ou dégradations.

Les usagers sont pécuniairement responsables de toutes dégradations qu’ils pourraient commettre.

Toutes réclamations sont à envoyer à Loisirs Loire Valley.

VIII – INTERDICTIONS GÉNÉRALES

Afin de garantir la tranquillité du public, sont interdits sur le périmètre de la Base :

· la distribution ou l’affichage de tracts de toute nature, de prospectus commerciaux sauf ceux pour lesquels Loisirs Loire Valley a donné son accord.

· Toute démarche commerciale est interdite.

IX – NON RESPECT DU RÈGLEMENT

Toute personne qui pénètre dans l’enceinte de la Base Plein Air adhère de fait et sans réserve au présent règlement. Elle accepte par conséquent de s’y conformer dans l’intérêt de tous.

Dans le cas contraire et après un rappel à l’ordre, le contrevenant pourra être accompagné à la sortie de l’établissement. Toutefois, l’exclusion pourra être immédiate si atteinte aux bonnes mœurs, dégradations du matériel, ou tout comportement illicite et sans avertissement préalable, notamment en cas de comportement dangereux pour les autres usagers.

Informatique et liberté

Les liens hypertexte présents sur le site www.loisirs-loirevalley.com et aiguillant les utilisateurs vers d’autres sites Internet n’engagent pas la responsabilité de la rédaction du site www.loisirs-loirevalley.com quant au contenu de ces sites.
Déclaration CNIL
Depuis 2006, les sites Internet n’ont plus besoin d’être déclarés en tant que tel à la CNIL. Les traitements de données personnelles ou nominatives collectées sur ce site par le biais de formulaires en ligne : nom, prénom, adresse, numéro de téléphone, adresse électronique font l’objet d’une dérogation définie dans la « Délibération n°2006-138 du 09/05/2006 décidant de la dispense de déclaration des traitements constitués à des fins d’information ou de communication externe ».
Ce site ne dispose donc pas de numéro de déclaration CNIL Données personnelles L’utilisateur du présent site est informé que, lors de sa navigation sur le site www.loisirsloirevalley.fr, des données à caractère personnel le concernant peuvent lui être demandé via un formulaire à remplir.
Ces données sont utilisées en cas d’une demande de prise de contact, ou d’une question de l’utilisateur, pour lui apporter une réponse.
